We have recently started having problems with our babysitter. She charges us $24 per day per child. We have two children in her care, as both mom and I work. Last week, both of our kids were sick, and only stayed in her care 1 day each.

She told us when I paid her that we were obligated to pay for the entire week, even though the kids did not go. I refused to pay her that amount, because there was never a contract signed, and it was the first I've ever heard about it. I paid her the full amount for this week, because now that I know her policy, I will adhere to it.

Today, she called my wife at 10AM and informed her that she (the babysitter) is sick and that my wife will need to come and pick up the kids.

Should we have a credit for this half day that she did not babysit?

Additionally, she has said that we are to pay her during any holiday that SHE takes a vacation, in order to ensure our kids spot with her. Is that right?

Wow--what a strict sitter. If she is a private sitter then you can either do what she says or find a new sitter, there are no laws governing what she does. If it is a daycare type setting then you should have been informed before your children entered care and signed a contract. I run a daycare and if the kids don't come the parents aren't charged. I ask that my parents please give me a call as soon as they know their child won't be there. I have a back-up sitter in case of emergencies (like I get sick or need a vacation) but the parents are informed as soon as possible and have the option of making other arrangments for their children and they don't have to pay if they don't bring their kids.

Well I guess the same could be asked by your employer, should you be paid for vacation or get sick time?

Most daycares private or public require you to pay even if the child is not there that way your child's spot is not taken. If this is just you and her and no other families involved its a little different situation. However, most people work out these details before hand. I personally would recommend you start looking elsewhere for your won peace of mind. This time making sure everything is agreed upon before hand. This includes foods late fees and anything else.

These are all things you should have worked out before she started babysitting. When my kids went to a sitter, she arranged for another sitter(with my approval) when she was sick or had a Dr. appt. I never had to pay her and another babysitter for the same day. I paid her weekly(not by the day) and if my child was sick and missed one day, I still paid her. She did take two weeks vacation each year, but I didn't pay her for those days. If you are being paid for a holiday, then I see no reason you shouldn't pay her for the holiday as well. It is really best to write up the employment agreement ahead of time as you are basically her employee.

Hum....I know most day care centers charge for days the child/children are not there because they depend on that income. Most only allow so many days of the child being absent during summers as well. If you don't have a contract and you don't pay her what can she do? I mean really. She can decide to not take your kids or if she does she may take it on on them somehow. I would hope not but you never know how people react under anger. And I would simply not pay her for vacation time she takes....Sounds like you need to find another caretaker and find out all the ruled and regulations before entering a contract...good luck.

In child daycare you pay for all days weather your child goes or not. You sign up for those days your taking a day that another kid could go. so therefore its only right to pay if your child does not go. Yes you should be credited for the sitter being sick. That's a huge inconvenience. If this woman is just a sitter and only has your two kids then I think shes kinda out of her tree for making you pay for days that she had a day off.

Did you sign a contract with this lady stating her policies? People get sick, like your kids did, last minute emergencies come up that we can't avoid. If you are "supposed" to pay her when your kids are not there, then you should receive credit when she is sick. It is not your fault she got sick anymore than it is that your kids got sick. If you signed a contract check it. If you didn't you should discuss her "policies", so that you can avoid any more matters like this. Find another babysitter.

Licensed day care facilities, in the caretakers homes, are licensed for a specific number of children of each age group. If they have your children registered for 5 days a week and they miss 2 or 3 days-the caretaker can't have another child use your childs reserved spot. In that case, you contract verbally to pay her a weekly amount for your childrens care. In the case of her being closed due to her own illness or taking off holidays-no you shouldn't have to pay her because you are having to pay some one else to do her job for her.

She is trying to take you for a ride. Why should you pay her when SHE takes vacations?? When she is sick, you don't pay. That is not right. If you still want to continue to keep her as the babysitter, I would negotiate something IN WRITING--something you both agree on. Personally, I'd find someone else. Something is not right.

If your kids are the only kids she takes care of and she does it on her home, then I do not believe that you are obligated to pay for any day that she does not take care of them. If it is a daycare center, then you have follow the rules they should have made available to you before you started dropping your kids off there.
