i just got my child from the state from her mother and they gave me full custody of her but she don't have my last name i want her to have my last name since i am the dad.

Was she somehow forced by the state to relinquish her parental rights? If yes, then you can go to the court and ask to change your child's name. If she still has rights, or is considered a parent by the state, then you cannot do so, unless she gives her rights up. And if she refuses to do so, then you will have to take her to court. I believe it cost a friend around $500.00 thru an attorney. Perhaps if you are lower income a state legal service can do this for you on a sliding scale. Every state has a legal service that you can call for FREE advice and possible discounted legal services. Congratulations and Good luck!!

The courts can advise you on what to do. They normally help you fill in the forms etc as well. Not complicated, and much cheaper than going to a lawyer.

In order to do this, I believe the father will have to fork over all of his paternal rights...pretty much saying that he wantsnothing to do with her...which means no child support either. But i am not too sure...

you have to go to the Court house and fill out a petition and then it has it to run in the paper to make sure no one will contest it then it will cost around $400.00

A judge does have to order this. Simple call an attorney and they will be able to tell you what you need to do.
