First of all why? The only time you should sue for custody is if the children are being abused/neglected. If the mother is a good mother, then you would be making a mistake. If she is abusing or neglecting your children then get in touch with child protection and open a case against her. They will then check up on her and that would get the ball rolling.

You can never spend too much on your attorney.
Talk to as many people as possible and get the name of the best Family Practice attorney in your city or county.
It will be very expensive but you will get custody of your children.

You will need to hire a lawyer to file a Motion with the Court requesting custody. Unless the other parent is willing to grant you sole custody, you are in for a long, expensive haul.

various factors come into play. You need to get an attorney; show proof that the mother is unfit; and then show proof that the children will be better off financially and emotionally with you. If you can prove that the mother is a drug-addict; alcoholic; abusive or neglectful; then you have a good case.
