it was the other persons fault but he is not taking the blame.my partner had a passenger in his car and put his name down as a witness we have now been told that we cant use him as he was in the car at the time.is this true or not.any help gratefully received

he didnt hit the car from behind but because he hit it at the side it has cracked the back bumper and boot by shunting it over

Hand all your details into your insurance company and let them sort it out, for if some driver as run into you it is there fault.

Unfortunatly theres no good news here. Firstly the passanger cant be a witness for obvious reasons - bias
Secondly, be prepared to go nock for nock. If you had been hit in the back you would be ok, it aqlways the other drivers fault. However weather we like it or nor (which we dont) insurance companies do not like roundabouts, 9 times out of 10 will will say both parties were to blame as this is the easier solution than trying to determine who's fault it was. I hate to be the barer of bad nes but the same thing happened to me 2 years ago and that went nock for nock
You never know though, maybe things are changing and they will start and fight on the side of the insured. GOOD LUCK !!!

Your passenger cant be used as an independent witness for obvious reasons- ie biased towards one party.
Give the details to your insurance and they will argue blame between you and the other party. Hardly any accidents are completely on persons fault, insurance companies aportion blame by percent, eg the other person was 90% at fault.
The other driver may be saying your partner came onto the roundabout too fast and cut him off as he was coming forward.
Just remember its an accident, I'm sure he didn't intentionally run into your car and at the end of the day if nobodies hurt its just a piece of metal.

your witness is of little use in a criminal case as said above independent witnesses carry a lot of weight. However did the police attend , were either of the cars recovered by a tow truck. was any one hurt. Was it the insurer or your broker that said witness of little use.If you feel that you were entirely blameless inform your insurer that under no circumstances will you accept a Knock for Knock claim and say that you would be willing to go to court over the matter. Finally you could hire an accident investigator local to your area and have them look into the case for you. However you would have to pay for the report and then add it to your costs against the other person assuming that the report was in your favour. but if he finds against you ,you could end up out of pocket

the passenger can only be witness to the fact that he was in the car and an accident occurred. As the accident happened from the rear, unless the passenger was looking out of the rear window at the time,it would be impossible to say how the accident happened

If the other car ran into the back of your car then I'm sure the insurance companies will say he is to blame, whether or not you have witnesses.
I think witnesses have to be independant.

If you were hit directly from behind ,then it is the other drivers fault.
If you take the other party to court with out a witness then you will still win, he was obviously driving to close to you.
Make sure you have photographic evidence.The pratt who hit you is in a no win situation,

Just file a claim with your insurance company. Then it will be their responsibility to go after the other guy and his insurance company.
