i think as long as its some kind of fruit or food its ok, a bird will eat it, or mice..

Did you drop it on the ground and not pick it up?? That is the definition of littering. There is no differentiating between biodegradable and non-degradable in the definition if you drop it and don't pick it up then you littered.

Yes its littering. Even if the little animals will eat it. Put it in a rubbish can!
