was in a single car accident on the 18 of nov the ins. company will not pay off my car that is totaled cause the police report has not been filed/

In Ontario we have ten days to submit the initial report. If the final report may not be ready if the officer is not done investigating the incident (ie. interviewing witnesses). Reports here also have to be signed by a supervisor. Contact the officer's supervisor and tell him/her about your concerns and get some answers.

It is totally up to the police department to set policy in most states. I have led 3 different departments and all had written policy that stated that no investigation would be conducted if the accident was reported more than 48 hours after the incident. why? Because the police have no evidence or minimal evidence when they don't have recent damage, see the scene, etc.

Most departments will however take a report from you. This is simply your stating that an accident happened. Remember that they will probably also find out what the other party had to say.

If the police were called at the scene of the accident, the file is made that day (usually). I would not be aware of any police report of an accident which is not filed at that time.

Perhaps I am misunderstanding the situation.

There is no "requirement" for the filing of the report. It'll get done when it gets done. Be thankful it wasn't a fatal. They take forever to do.
Besides...what are you doing the work for your insurance company? Most police departments provide operator's with a "summary" sheet that has all the basic information needed to file a claim. You see...what the insurance company wants is to see if you're listed as the "at fault vehicle". Then..they'll deny your claim. They're all alike. Companies run by a gaggle of attorneys whose only sole purpose is to make money and rape the public...driving up our taxes in the longrun because of frivilous lawsuits and shafting people on insurance claims. Tell your insurance company to get off their dead a*s and get the stuff they need themselves like they're supposed to and pay your claim.
