no you can marry him here but if you want his paper work process to go smoother........... act like he has never been here and file his paperwork as if he is in mexico ......... i know they banned my husband for 10 years over crossing the border illegally........his only "crime" ............... oh_hell

NO, NO, NO you don't have to marry him in Mexico despite what others on this board will tell you. There are cities that will allow the two of you to marry despite him not having a ssn, like Atlanta for expample. Do the research and find the place closest that will help you out. If he is here illegally then you want to keep him here as long as possible. Leaving the country to marry in mexico is a recipe for disaster, it will only prolong your time apart. Marry here in the U.S.
File the I-130 visa application
INS will send back more paperwork for you fill out, fill it out and pay the fees
The case will be sent to CDJ to await an interview date
Once you have an interview date, your spouse will return to Mexico for his interview. At this first interview he will be denied for being in the country illegally, but as long as he qualifies he will be able to file the I-601 waiver and you will have to write a hardship letter. If you are able to do this then they will give you a date to come back and submit this paperwork.
Then the wait begins. You will have to return to america to wait out this process while he stays in mexico. HE CAN NOT COME BACK TIL THE CASE IS COMPLETE AND HE HAS VISA IN HAND. this could take up to a year or more.
All o the above applies only if he is eligible for that waiver. If he has crossed the border multiple times, been caught by border patrol. or been depoted and re-entered then he may have a lifetime ban, which means that he will never be eligible to come to this country legally.
If immigration reform is passed inthe Spring like is expected to be and your husband qualifies then he will not have to leave the country or submite the I-601. he would instead be allowed to interview here and pay a fine or either 1,000 or 2,000. Exact fine amounts have not been decided yet.

If he entered the country legally (for example over stayed a tourist visa) then you should be able to get married in the US and then apply for an adjustment of status for him as your spouse.
If he entered illegally (never went through immigration) you can still get married here but immigration might be a problem. He may need to leave the US then apply for reentry. It's best to talk to an immigration attorney about that.

You can marry where ever you want, but keep in mind that while INS is doing there process, he will undergo a background check, an dwill have to provide many documents to show he is divorced or never married, and or residence for several years back, and be sure your doing it for the right reasons. He might be wonderful now, but some (not all) change, once they get their papers.

no...in fact in the u.s. you can legally marry an illegal. i know someone who did this...she married a guy from mexico. one thing though it will not automatically make him or his daugher a u.s. citizen they still have to go through the immigration process.and you will have to adopt the girl. if he is already here illegally then he cannot apply for citizenship, he has to go back to mexico get apply for a work permit or visa, then come here and apply for citizenship....check out all the details on www.uscis.gov, its the u.s. citizenship and immigration site.

no, you can marry him here in the US but when you start doing paperwork so he can get his legal permit to stay in teh US he will have to go to mexico for a while maybe more than a year,(some people do not have to go, but most of them do)
think about it, do you really want to marry him for this reason, if you do not love him, do not marry him.

You can bring him over to US on fiancé visa and get married here. He will get his green card after you are married and immigration reviews your paper work. You will have to check with Immigration and Naturalization Service www.uscis.gov
