Wow, I'm at a loss for words here.
Your attitude is objectionable, to say the least. Medical errors do happen, and sometimes they even hurt people, but in your case it sounds like you got off without harm.
Understand this, if you go to court, you're going to loose, in order to get money for any medical treatment gone wrong (or that was unnecessary in the first place) you have to prove that it harmed you - and I don't think the inconvenience of having had to lie still for 2-3 minutes for the scan and get some IV contrast is going to be terribly persuasive to anyone as damages.
"Emotional distress" comes with life, my friend, if that's the worst thing that happens to you this year, you're doing pretty well.
It's true that a mistake was made (if what you're saying was accurate) but I would be very careful in how much you ask for, since you haven't been harmed. If I were you, I would stop thinking about how much you can squeeze out of whoever made this error and just be happy that you're healthy.

I agree with "The Doc"....I just had a CT SCAN yesterday. An MRI is much harder to deal with than a CT SCAN and even that shouldn't be worth anything if you had one you didn't need. To me, this is silly that you even think you deserve money. The test didn't hurt you in the least. People who have sued for lame reasons such as this, is why we pay the high cost of insurance and for medical procedures. Plus hospitals/doctors pay high protection insurance for stuff like this also. If you cannot prove how you are hurt, ( I do sympathize the stress of what you thought might be wrong but since nothing is, you should just be relieved and not looking for an easy buck ), you aren't going to get much if anything at all.
I had a much more serious thing happen to me and I was told I wasn't entitled to anything. I was prescribed steroids for something and the doctor didn't write the script appropriately and I wasn't weaned off the drug. Two days later I thought I was having a heart attack as I had all the symptoms. I went to the doctor who prescribed the previous med and he could find no reason why I was having the problem I was, so he sent me via ambulance to a hospital where a nurse figured it out in five minutes. She asked what drugs I had recently taken and when I told her she immediately knew why I was having the symptoms I was having. Cause I had that steroids without properly being weaned. That DID cause me pain and huge concern and plus the doctor should have been intelligent enough to know how to accurately prescribe a medication. When I inquired about suing him, ( Not because I felt the need to be compensated but because I didn't want that yo-yo to have the opportunity to screw someone else up ), I was told that if I had no real physical harm done, there was nothing I could do. You basically have to be severly harmed before you are entitled to anything.....
Soooooo be glad you are ok, and don't be sue happy....

I would suggest you really reconsider the malpractice suit. You should simply be reimbursed for the charges. People make mistakes. People are so quick to sue everyone for little things. At least you didnt have a leg amputated or brain surgery. Its a cat scan!!!! come on. Simply be greatful that you are okay and you have nothing to worry about. Think about the poor person who does need the chest ct. If it wasnt found out, they could have lung cancer but never know. Put yourself in the other peoples shoes before you rush right away to sue everyone. Emotional distress - over a cat scan!?!?!

The situation you describe is not malpractice because you were not harmed by the mistake. Mistakes happen. Can you honestly say that you have not made a mistake that inconvenienced someone else? It is unreasonable to expect that medical personnel are any less prone to make mistakes than others
Why don't you ask for the results of the CT scan? You should not have to pay for the results. CT's are very expensive, so you could consider yourself lucky to get one for free.

To be honest, this settling out of court and patients constantly going to law firms, is really starting to leave a bad taste in my mouth.
You had a scan - You had some dye injected - you survived, no major surgery, just A SCAN and SOME DYE.
I would be thankful that it was a mistake, and also pleased that hey they would have checked out my scan anyway.
Stop complaining, give a little for human error, and MOVE ON!!!!

Seriously, its just a CT scan, its no biggie. Its not as if your life was placed in any danger. "Emotional distress" is a lawyer's favorite phrase, but in the real world it doesnt mean much. I get emotionally distressed just by commuting to work every day.
But I m sure a lawyer will probably say its worth your ( and certainly his ) time persuing the claim.....

personally the best advice i could give would be to just ask that the charges for the CT be refunded to the insurance or whoever paid for it and leave it at that. a malpractice suit is a very difficult thing to deal with, you would be going against a multi billion dollar industry that has only lost maybe 3% of all cases ever brought against a doctor or hospital.

There's really no sense in pursuing the matter further. At least now, if you ever have anything wrong with your chest, they have images to look at. I've slipped a couple of times with paitents but luckily I've caught myself. I'm sorry, mistakes happen. At least they didnt do a Biopsy. Again, sorry, but I would have to say drop it.

i think of paying the CT Head test could be the main unsightly. hiya, chum, i'm relatively sorry which you ought to bypass by way of this. i wish and pray that they discover an answer for you directly.

its jut a CT Scan. ive had plenty of those done.. they dont hurt. but if your going to sue this person for making a mistake then maybe I should sue you for being so greedy?
