You signed a paper giving up custody. You legally owe child support regardless of your reasons for not being able to pay. If your statement that you "sent a check already" means that you are caught up, no you cannot be arrested. If you are behind, it us unlikely that you would be arrested anyway. Instead, you will be ordered back to court to show why you failed to pay child support. You need a family law attorney to protect your interests. This is not a matter that you are capable of handling on your own; especially where your husband has more money. Depending on your ability to pay, you could petition the court to lower the monthly child support. Also, if you wanted the children back, you could possibly get them if you could prove that your ex-husband coerced you or you were under duress due to a medical and/or emotional condition, if you can prove you were at the time. You also can use his abuse if it was documented. If this problem has been resolved by bringing your payments current, don't worry. If you feel that the problems will continue, you NEED to get a family law attorney. You need to remember one thing when it comes to the law. The law does not take emotions, tears or personal pleas, sad as it may seem, into consideration. The law is based on facts. Gather all the evidence you can and present a solid, factual case and you will be much better served.

You cannot be arrested for being late on child support as far as I know. You can have your wages garnished if you don't pay on time however. I am sorry that your kids got taken away. If you report abuse in the home and then get divorced you ex would have a record of abuse and not get custody of the kids. Even if you don't press charges against him you have to file a police report in order for there to be documentation on him which will show up in a background check. You can talk to a lawyer about having the papers you signed be nullified because you were ill at the time you signed them and you were being told false information at that time as well.

You need to get a lawyer... if you can't afford one, go through legal aid. If you were forced to sign papers against your will, or blackmailed into signing them to get the medical care you needed, that should be taken into consideration. Sue for full custody of your children. And as it stands now, it should be shown that if you are behind on your rent, you are in no position to pay child support.

The ignorance of the child support system is not unusal, but you must pay the court orderd amount every month or you will be held in contempt of court.
The court does not care if you $100 or thousands and no reasonable reason is acceptable. They demand full payment every month.
You people need an education in Child support laws, your ignorance wil cost you dearly when it's your turn

contact your lawyer i highly doubt it. why? would you sign any paper? you need a lawyer and if you cannot afford one contact prairie legal services get those children back or at least joint custody. do you have any family or anyone supporting you? please get some to be there for you. you have my best. fact is that before you would get arrested you would get ordered to go back to court to show just cause. you would explain to them what you did to us and that's ,that. don't let this manipulator scare you.

You could be arrested for failure to pay child support but your case would likely be excused due to medical reasons. I do however think they go after more serious offenders like those that don't pay for a long period of time.
