No it's not stupid....

all they are doing is exploiting a loophole...but they (our supposed government) are working on fixing that...

or so I hear.

The constitution does NOT allow for anchor babies. The Bill of rights and the amendments thereof does NOT allow for anchor babies.

What IS stated and has never been heard in the supreme court
is for the babies of X slaves, "to be a whole person; born within; the subject jurisdiction of the states."

A illegal is not subject the the jurisdiction of the states for hopping over the border, to say so would be to eliminate all procedure to be a citizen or legal immigrant. This has been the fabrication of the ACLU.

This is an outdated loophole in our laws that causes further incentive and motivation to illegal immigration. A person should only gain US citizenship if born to at least one legal US citizen parent. If neither parent is a US citizen, the child should only have the citizenship of their parents and should be deported along with the illegal parents. As someone else said, this is being looked at by government and hopefully will be corrected before too long. This will not cause children to have no country - they will have the citizenship of the countries in which their parents have citizenship and this is only right. I, personally, would not be opposed to the children having US citizenship even if their parents do not, as long as the parents have legal residency, i.e. they are in the US legally as immigrants with permanent residence status. This would encourage legal immigration rather than illegal immigration. I do not think someone visiting on vacation who then has a child should be given legal citizenship. I have heard that there are countries where the citizens purposely go on vacation to the US when their child is due to be born, solely for the purpose of acquiring US citizenship for that child and for the purpose that when that child is an adult he/she can return to the US and then sponsor the rest of the family members to immigrate to the US. This is also an abuse of the privilege of US citizenship.

Because some believe that the law enacted that allows anchor children to stay was never meant to work in this manner. It was designed to enable the children of legal immigrants who had not achieved citzenship but were here and gave birth to be automatic citzens. These are harsh times, the situation is serious, and thus it requires some serious steps to rectify it. We are not trying to kick these children out, they are not refugees, we are merely trying to remove one of the incentives for the illegal adults to stay. After all, they are not Americans, they are criminals, they are, in legal terms, trespassing. If I were to trespass, I would be ticketed and fined, possibly imprisoned. These people are at worst sent home.

Why do US Citizens and Legal Immigrants have the burden of paying for these Illegal immigrants to have their children in the US? If the US government is smart, they should yank all citizenship status of any child born here to illegal immigrants and yank all social services unless you are or were a tax paying legal resident of this country. That should send them all scurrying back to their country.

This free for all has got to stop.

Children born in this country are citizens. The Constitution establishes that fact. If the parents are illegal, they need to go back to their own country, or be sent back by whatever means necessary. The U.S. citizen child can return when he or she is of age, or stay in the us with a legal resident sponsor. That should be simple enough for a loony leftist or a ridiculous right winger to understand.

Thoase children cost the tax payer no more moeny than the average American child.

California spends $50 billion a year on education for all white, black, hispanic, chinese.

Hell, the government just spent $600 billion on helping Iraq, what are we all complaining about?

The reason is that the child is a dual nationality to begin with, the parents are using the child to get benifits they should not get and the cost of society having to raise the child is astronomical-Lifelong welfare case!
It needs to stop-last thing this world needs is to encourage Hispanics to have children-like giving a Rabbit Viagra! LOL!

To make the question less emotional, ignore the already born ones and consider this. Going forward, a woman who is 8 1/2 months pregnant in Mexico who has her baby in Mexico has to pay for the birth costs, cover they child's education, pay for health costs and food costs and shelter costs for the child, and if the child ever goes to college in the US has to pay for foreign (not taxpayer subsidized) tuition.

If that woman 8 1/2 months pregnant walks across the border and into a US hospital to have the baby, all she has to say is that she can't pay and we have to pay the child's birth costs and health costs going forward, and food stamps and aid to family with dependant children (defraying housing cost for the mother and rest of family). WE have to pay $10,000 per year for that child (and any others the mother has) to be educated at our children's overcrowded schools run year round to support excess kids, with emergency credentialed teachers.

Then the kid at age 18 or 21 can 'petition' the rest of the child's family in 'legally'.

That is a huge burden on us for a foreign baby of someone here illegally, and that burden is ruining our own schools for our own children. It is a truly stupid situation, and one other countries (Ireland and Canada fairly recently, I believe) have changed in their own laws.

Being born in USA is what is essential. Thus, there are many who get their children out of the country but will return when they are already grown-ups to study or work.

Technically, the "US citizens" are cheating the system by "anchoring" themselves to a country through the roots of their children. I think it is a poor reason to have a child. And I think that children should assume the nationality of their parents.
