My husbands ex wife has had a baby with another man it was born addicted to meth and she got it taken from her, and her mother has custody as of now and she went to her mothers house hit her mother over the head with something and shen tried to take the baby but was unsucsessful the cops came and she was resisting arrest and she tried to bust out all the windows of the cop car. I was wondering if she would serve any time for this or what would happen. The cops have already said that they were pressing charges against her but I dont know if her mom is. Can anyone answer this question for me.

I would imagine that assaulting a police officer, plus any criminal damage would be enough, no matter what her mum did.

Oh yes she will get jail time....it is her own fault that her child was taken and placed with her mother...The mother will probably get a restaining order against her for doing this and she will not be able to go back to her mothers house again,and if she does she will be put in jail....The girls mother taking the baby was a good thing because had she not taken it they would have placed the baby in a foster home and she would never see it...The best thing for that mother to do is get clean and stay clean ..Im sure if she proved herself to become a good mother then she might could get her baby back..If thats not possible it would be good because if she ever cleaned herslf up ,im sure her Mom wold let her at least visit with the baby..This girl has ;lots of problems and right noe she does not deserve her baby back...

Even if the mom doesn't press charges for the assault the state can press them for attempted kidnapping. She will be gone for a while. What an idiot. Perhaps she should get off the meth and get her life straight. Then try to get the baby back without hurting anyone. Good luck with the situation.

She could be charged with parental kidnapping. Though the child is biologically hers the law has seen fit to protect the child from her. If she goes against the law and tries to take possession of the child on her own, then she is seen as a further threat to the saftey and well being of the child. Depending on the people (law enforcement, judge, etc.) involved in this matter, she could loose the child permanently.

If the cops are pressing charges then she will stay in jail until her hearing although if this is her first offense then they will probubly say it is a misdeamenor and let her go on bond. She may also get charged with attempt to abduct a child, she may have to also go to drug rehab to try and get her child back. Sounds like a bad situation.

She will get time, pretty much no doubt about that. The really sad thing is, her chances of getting her child back, eventually, are pretty high after she gets done doing time. Especially if she goes into a drug treatmeat program while she is in jail/prison.

And I do NOT think any person who has a baby addicted to ANYTHING should ever get their baby back......I could care less whether they get there life together...or not!!!

The crime she committed is a crime against society and therefore doesn't matter whether or not her mother will be pressing charges. From the sounds of it, this women needs to be locked away and that child doesn't need anything to do with her. She should be locked away until she gets clean and can realize the detriments of her actions. Good riddance.

Even though it is her child, and she lost custody of that child, she can be charged with kid napping regardless. She lost the right to have physical custody when she chose to poison the baby, W/O giving it a chance. She deserves everything she gets. I dont feel bad for her.
