If you were considered legally married on Dec 31, 2006 you must either file joint or married filing separate. You pay more in taxes no matter what if you file married filing separately. You pay the least amount of taxes filing joint. If you file single to head of household you will one time get audited and will have to pay back taxes and huge penalties that rack up each month.

Depends on a lot of variables e.g your tax bracket, your dependents and who claims whom/what.
