For example their are underground poker clubs in New York. Some have been busted by the police and closed --- and arrests have been made of the owners and dealers .... but to my knowledge it has never gone to court and charges are usually dropped.

It all depends if poker is considered a game of chance or a game of skill. Most anti-gambling laws prohibit games of chance but allow for games of skill. Here is an article from the UK on the issue but it is applicable in the US as well

Only if the person who owns it is old enough to own it and as long as there';s no one underage and as long as they have a license. It's illegal in some states though.
