You can file taxes using an Individual Taxpayer ID Number (ITIN), which you get from the IRS using form W-7. The ITIN is different from the Social Security number and does not provide legal work authorization. Instead, it is used to allow an individual without a SSN to pay taxes. In order to work in the US, you generally are required to have a SSN. If you file under the SSN or if the employer submits tax information using that SSN and it is not your personal SSN, the employer will get a "no match" letter from Social Security. The no match letter will not get the employer in trouble by itself, but can be used as evidence that the employer knowingly employed someone who was not legally authorized to work in the US.

An illegal alien can obtain an Individual Taxpayer Identification Number (ITIN). It allows them to file a tax return but is not authorization to work. IRS law doesn't differentiate between legal and illegal aliens, Anyone earning in the US is required to pay income taxes. If an illegal alien filed a return reporting income from a source other than wages then they would use the ITIN. If they report wages then the alien and the employer could get into trouble so the usefulness of the number is limited.

NO - Here is the answer you are looking for. There is something called an ITIN number - individual taxpayer idendtification number. It is for the the sole purpose of filing taxes - same format as ss#, but not supposed to use to work, only file taxes. Very much the double standard here!
My husband used this before he became legal. Once the person becomes legal and gets his/her ss#, that cancels out the itin#.

How can you pay taxes without a ss # If you don't have one and are illegal I don't see what rights you should have for a return. I have no problem with immigrants, just the illegals taking away what we have paid for and can't get.

No, you need a ssn to file for taxes. Even if they were using a false ssn, they couldn't file, as it would come up as a duplicate and they'd be busted.
Illegal workers (with a phony ssn) pay into the SS system without getting anything back.

Foreigners can and do get special numbers to file. However, if you are working illegally, you are ALWAYS subject to deportation. Are you really planning to ask for money back? Do you have no kids in school at $10,000 per child per year cost to tax payers?

Unknown, but since many have social security numbers
(anyone working and paying into SS gets one) and if they pay into social security , they will most likely be paying the IRS federal taxes also.
If they qualify for a refund because they overpaid taxes, then they should get the refund.
Would you be happy if you overpaid taxes and people tried to deny / steal your refund ?

He can't file unless he is using someone else's social security # which is, of course, a identity theft and a felony) and yes, if his boss is hiring illegals he can "conceivably" "get in trouble" although the laws seem to be broken with impunity.
