I have an old picture that I want to make a copy of.But it has an old copyright stamp on it.The picture is about 28 years old,and I want to copy it at the store and but they won't let me.The photo shop where the picture was taken doesn't exist.What could I do?

ASSUMING that the old photo business is no long in existence, consider using a good scanner and get a copy of the image onto a CD or a memory stick and take it to any commercial printing store. That might help you deal with the situation. Or, scan it and send it via internet to any number of services that print images, like Walgreen, Walmart, K-mart, etc.

I do frown on some of the copyright practices, and this is one example. If I pay for a photo to be taken, why should I sign my life away by letting someone have control over MY image after I have paid for a service? Hardly seems fair... seems more like some people knew how to "cover their rice bowls"!

By the way, I've been involved in photography for a little over 43 years, and I've made a living as a photographer, too. I make copies for my clients and their relatives as part of the package, and I also make it possible for them to buy the films from me at a reasonable fee; I don't hold the films "hostage" for life as some modern-day "photogaphers" do in order to continue making a dollar off the same clients (maybe that's why I've had people contacting me throughout the years... since the 60s, 70s, 80s... I've done their graduations, their wedding, their children's Christening, children's graduation and children's weddings, and have taken photos of their grandchildren, too). A profit is one thing, but... how much is enough? Greed is a harmful element in photography.

The problem of "orphan" copyrights -- things copyrighted but essentially abandoned by the rights owner and hard to trace -- is a tricky one the US Copyright Office has been trying to deal with, and it is particularly hard in the case of photos. If the photo was taken 28 years ago, it would still be in copyright.

As a practical matter, you may have to abandon the thought of using the image in a commercial project, unless you are willing to take the potentially big risk that someone will recognize the use of the image and will sue. If you just want the copy for personal use, while that is still a copyright violation, the damages are small and it would be virtually impossible for the owner to find out, so you may want to go ahead. My guess is that it wouldn't be too hard to find a different photoshop willing to copy the photo for you.

You can buy a copy machine only for pictures that you hook up to your computer and it's easy really and it only cost between thirty dollars to eighty dollars.GOOD LUCK!!

do you have a scanner? if so scan your image and E-mail it to a place that is commpletly automated (like walgreens) it will be ready in about an hour. you'll be alright as long as your just using it for personal use.
