In 1998 I purchased a Rifle(30 06) and I had it registered in my name when I bought it.A year later I divorced my husband and moved but could not bring my gun at that time and my ex agreed to give it to me when I asked 4 it back.
He refused to give it to me but now he only has weeks of his life left due to cancer and I asked him again to give me my gun but he refuses and wants to leave it to his brother.Seeing it is still registered in my name.Can I Get it back?If so..Who do I contact in order to do so?

While you can probably get the rifle back by hiring a lawyer, the cost is most likely going to be prohibitive. While the rifle may have some sentimental value to it, your best bet is going will most likely be to just purchase a new one.

The only other possible way I can see if you report the gun as stolen to the police but it will be complicated by your not doing so at once. However you can certainly inquire to the local authorities as to what they can and cannot do for you.

One thing you didn't answer is whether or not it was in your divorce decree. If it wasn't mentioned, it may be tough to get it back.
We couldn't compel someone to give property over usually, without a court order. Get your divorce papers out and read them thoroughly, you may be able to get the rifle back with the help of the Sheriff's civil section if its in there. You may need what we call an order of execution where law enforcement is compelled to assist you. I had one of these written into my divorce papers for when my ex got cute about not giving me my kids.. Otherwise it just goes as contempt of court, and takes forever to get help.

Legally, that gun is yours. That serial number is registered with your name. If they refuse, contact the civil department of your local police department or sheriff's offce. They will assist you in getting it back. They might instruct you to have a lawyer ready. It is a pretty easy case, it is a registered item in your name. Unless there is a bill of sale or a contract that states you gave/sold it to your husband, it is lawfully yours. Good luck.

It's a civil matter. You can take him to civil court or wait until he passes away and make a claim against his estate. You'll need verification that you actually purchased the firearm such as a bill of sale or the firearms transaction records. Firearms dealers maintain those records for a long time.

talk to your ex husband bro personally.if he refuse, ask a lawyer to sort things out or even log a police report with the original receipt and registration.
As the gun is registered under your name, you have the responsibility to safe guard it. if anything went wrong, u will be the first person approach by police.

Was the gun listed separately in your divorce settlement? If it was, you can get a court order to seize it.

If not, you will have a hard time getting it back. You can hire a lawyer, but it will probably be cheaper for you to just buy another one.

Talk to the local police dept. If you show that you are still the owner, they most likely will have an officer meet you at your ex's place and order him to surrender the rifle to you.

It sounds like a civil matter and the police cannot compel him to give you the rifle. You need to pursue it in civil court.

you personally contact the local police ( with proof of registration)
they should be able to help you get the gun back or instruct you on your rights
