NO. And, even if he did marry a US citizen he would not be given legal residency. That's the law - your friend needs to talk to an immigration attorney and understand what he is facing.
He has 2 choices - stay here illegally and deal with that. Or, go home to Mexico. If he ever does marry a citizen he will have to go back to Mexico in order to get legal entry - which he may Never get - married or not.
Unless the laws change!
Lin & GG are giving mis-information. I doubt they have had any personal experience with Immigration law.
Beign married & having children with a US citizen gives you no weight with INS.

The answer to that is sadly no. I know someone who is an illegal immigrant that married a US Citizen (who is now pregnant) and he will soon be deported. If you marry a US citizen it doesn't make it any easier now a days. Long ago, immigrants were able to marry a citizen and easily become one. Now they are very strict on that. So when an immigrant plans to marry a citizen and apply for citizenship they keep a close eye on them even if they are living together already. This could go on forever.

No you can not become a citizen of the united states by having a child with a U.S. citizen. He has to apply for citizenship and pay all the fees attached the application. I wish him luck, because the laws have not really strict on legal immigrates.

No they have to apply for Us citizenship or marry the US citizen. Having a child born in the US only means the child is a US citizen not the parent.

If he's not a citizen how did he get a US drivers lic in the first place? No you cannot automaticaly become a citizen if you marry one or have a child,it is my understanding that you have to return to your country of origin complete the proper paperwork and wait for approval.

As I understand it, he is not a legal resident unless he marries an American citizen. However, his child (whether both parents are immigrants) is a US citizen.

No and I hope that this person didn't have the baby in order to gain citizenship. The baby is a citizen but not the father.

No. When the child is 18 or 21 ( I forget which) they can petition for their parents to come, but not before.
