when filing head of household (married considered unmarried) with one child. (EIC)

will they ask for my spouses ssn or info on him?

No, but your spouse can't be living in your home for the last six months of the year. Even staying one night technically counts as being there.

Head of household requires no information on a spouse. Many head of houselhold filings are for unmarried heads anyway. The only time info is required about a spouse is on a married, filing seperate return.

If two adult taxpayers abide under the same roof (or are married and consider themselves married; ie maintain finances together), they are married filing jointly or married filing sep. It is fraud for each person to say they are broken up and each file Head of Household. One must have a dependent to be a HOH.
The fines and penalties and back payment of taxes can be horrific. If people think they are too poor to be affected by the IRS, think again. Food Stamps, Rental Help, and State Med Aid can be taken away as well. Just trying to help : - )
