My boyfriend (from Europe) and I have been together for almost 15 years. He has helped me raise my kids (their father hasn't contributed a dime), put my daughter thru college, etc. We tried to get married several times but couldn't because his wife refused to give him a divorce.
We lived in another state and decided to move. Before we moved he had a work authorization card and a s.s. card (both were legit) and we went to immigration before we moved (because he had to report yearly) and they told him that they would mail him his new card. We gave immigration the address that we were moving to and waited and waited.
One day a letter from immigration came in the mail, forwarded by his old boss (he jheld it for about 6 months), saying that he would be deported if he was found. Last year his wife finally gave him a divorce but now we can't get married because he is illegal. What can we do?

If your boyfriend came to the US on a valid visa and maintained that legal status until just recently, then yes, you should be able to get married and file the I-130.

Your boyfriend, may however, have to return to his country for processing of the I-130.

It would be a smart idea to engage an experienced immigration lawyer for this situation though, because there is the issue of being out of status for a time.

Look this whole story is a "five star" story of drama. What I would suggest is to find you a good immigration attorney to help you with this mess. There are so many issues here I would not even know how to suggest any advice. An immigration attorney can help you. Just be sure you have at least two or three thousand to pay the immigration attorney. Really you have a mess.

Besides you are getting married for the right reasons, not just for citizenship!
