For the most part at what age is the offender?
1) For MA they will first find the host of the party and/or dwelling. 1) They could arrest/summons the owner, renter and host. 2) The minor could be arrested/summons into court for under age intoxication.
and
2) The police could arrest and/or summons you to court. Seize the drugs and for the most part if you’re a first time offender you could be forward to a diversion program.

In Texas you can be fined, license suspended & probation new law this year. It depends on the laws of your state and the cop. The cop could be nice and let you go with a warning or just call your parents. But they are getting tougher on underage drinking. The pot you will be arrested.

The only real answer is "it depends upon the laws of your state and the decisions of the particular officer who stopped you".
In TX, underage drinking is a class C misdemeanor (traffic citation). However, you can be arrested and taken to jail for any violation except speeding or open container (of an alcoholic beverage).

My guess is pour the drink away and take you home - tell parents and get a warning - you won't get arrested for smoking pot (in Britain) but they will want to speak to someone responsible for you. Tough break. Play Sensibly!!

Probably in my town you would be taken to your parents with a warning, not sure about the pot situation though is that a shady area with under aged kids? Can't help you with the pot one.

It depends on the cop. They sometimes take kids in and just make their parents come and get them and it goes on your record. Sometimes they just let them go with a warning. Usually not if alcohol is involved though.

Our local PD would typically turn you over to your parents with a citation and/or court date. You would also have your driving privileges automatically suspended.

In the old days they probably would have given you a warning but nowadays they want to throw the book at you even if they have to lie to do it.
