So I am driving the other day , I go into an intersection and a guy from the far left lane goes into the middle lane after I am getting in with my signal. He goes in with out signaling, so he hits the front of my car and then stops. We get out and once I get to call the cops he makes a run for it. I am just curious because I had a person in the car with me. Can they be my witness and does he running make it his fault ?

Yes, the guy made a run for it once i called the police. I got his plates down and then the cop came and made a report. I have to call them on Tuesday to explain that facts. Or they will close the case. I am just curious as to what will happen and if my car will get fixed. I mean I am starting to wonder if he had a license or insurance. So i am worried I may not get my car fixed and have to pay for it to get fixed.

The fact that the person did not signal will make him responsible for the accident and the fact that he fled the accident scene will make him guilty for hit and run as well. I am not sure if the other occupant of your car would be considered a witness, but I'm sure there were other witnesses on scene...? When the cops got there, was the guy who ran away still gone? That would be proof to the cops of a hit and run! Good luck ;)

Leaving the scene of an accident ie: Hit and and Run can be a felony offense in some states. Pursue the SOB with all your might, your passenger certainly can be a witness. Stay on top of the cops on this issue becasue with all the other BS going on these days a minor hit and run is pretty low on their list of priorities but you need the other guy aprehended so you do not have to pay for damages yourself, also report this to your insurance company immeditately to protect yourself, they also do not want to pay out so they will also help you in pusuing the matter. To make a long story short- No.
It does not affect whos fault the accident was if the other driver leaves the scene... that is a whole seperate criminal offense. The fault of the accident is decided by recorded statements, scene investigations, witnesses etc.
Unfortunately.. worse case scenario here.. with no INDEPENDENT witnesses (your friend will side with you of course.. insurance knows this) this will likely be word vs word and his insurance will not accept liability as they do not have enough evidence.

Does it automatically make it their fault if the run after an accident? No. It does make them guilty of leaving the scene of an accident though, which is a crime in most, if not all states, and can be looked at with the other evidence to establish fault in the accident.
But if you, for example, ran into the back of my car, clearly your fault, let's say I was stopped at a red light, and I for what ever reason chose to leave, my leaving would not suddenly make the accident my fault.

The person in your car sure can be a wittness and the other guy running sure makes him look at fault. Hope you have his plate number and personal description, cops will get him.

The fact that he ran tells me that he had either no license or no insurance, probaly nothing..... yes it sounds like it was his fault...it is good you had a witness. But if he has no insurance no one will pay to fix your car.....
