you would first have to define rape. if you mean having regular sexual intercourse without the consent of another then you would find it tough in some states with this one. some states have actually made the ruling that a man cannot be raped in so far as if he is having sex of a normal or traditional manor with a person to who he may be reasonably attracted to. meaning a heterosexaul male could be sodomized by someone and call it rape but if a attractive young woman makes moves on him then it would not be rape, since in a few states they have deemed that a male under duress and in a state of fear is unlikely to attain or sustain an erection for the course of a sexual encounter.

so that would bring us to what state and then good luck with the judge.

The minor but they would look at the situation and judge based on what happened exactly. And minor can mean ages 1-17.

If the minor is female and I am the overage man,

IMHO the punishment would be entirely hers alone.

If you mean a "forcible" rape, then the person using the force would be punished.

Wow....never thought of that. I would assume the adult because they are suppose to be responsible to make a right or wrong decision....unless they are handicapped or mentally impaired.
