My babies daddy is now 16. Both his parents are in some form mentally challenged but totally wacko. His mom has come after me with her gopher stick and electric wheel chair! In Pa, can someone tell me what rights and his chances of getting that with his parents having a smaller mental capacity? His mom has been into nursing homes and has tried to "escape". I try my hardest to respect that woman, but she pushes my buttons. His sister, him and his parents are constantly fighting (baby is never there. Always with me) Can someone help?

In many states, you can just leave once you reach the age of 16 or 17 if you wish to do so, and the legal process of emancipation is not always necessary. Just remember, if he is emancipated, his parents are no longer responsible. He will need to be able to pay his own bills, like rent, medical, food, etc.

He has to get a lawyer and go to court. So my advice is talk to a lawyer.
