I am currently 4 months pregnant. I turned 21 in Oct. and didnt get my license renewed because well...i guess i was being lazy. While i was driving my boyfriend to work with my son in the backseat, i stopped for a bus (on a backroad). Kids got off the bus and the bus drivers "stop" sign was still flashing. I was behind the bus...well when i was stopped and waiting..a women came up behinde me and rear ended my car. i didnt hit the bus...my car just spun out of control and she smashed my break lights in and my trunk is smashed a bit as well. she was driving her mom and dads car with liability insurance. i on the other hand discontinued insurance on my car so was without. is there any case for me out of this or am i just simply screwed? my mom says call a lawer to see if i can get anything out of it b/c people are suposed to carry non insured cars insurance????? what do you think?
my son and i were fine, along with my boyfriend. all checked by the EMT's. my blood pressure was a bit high.

The person that hit you was at fault and their insurance should pay for your car and your medical bills. However, since you had no insurance, you'll be looking at fines for that and for the suspended license. See a lawyer before you do anything at all.

It sounds as though the other driver is at fault in this accident. Their insurance should pay for the damages to your car. Thats what liability coverage is for. In the meantime, please get your license renewed and purchase liability insurance for yourself. You can see how the mistake that driver made could have easily injured you, your unborn baby, your son and a school bus full of children. Anyone can make an error driving and be at fault in an accident. Insurance premiums may seem high sometimes, but if you compare the premium to the cost of a serious accident, they really aren't.

well clearly the other driver was at fault here.. but what is going to come into play is whether your state has a rule in that if you dont have insurance you can't collect through other peoples. Call the other drivers insurance and file a claim.. worse they can tell you is that they cant pay out.

as a side note... i understand people have financial problems.. but.. how on earth as a mother can you drive your son around with no insurance? What if he was hurt in an accident? What if you killed someone? I have to make calls to people everyday telling them that they now owe 30k because they drove without insurance and injured someone. Its not fun for me.. and is alot less fun for them. Get insurance. its not worth it to drive without.

The person that hit you is at fault for the accident. You just need to call their insurance company and turn in a claim. The other company is not going to care if you have insurance or not.

But please become more responsible. Get insurance and get your licensed renewed.

You didn't hit her, so your insurance shouldn't be a factor. Find out how much it will cost to fix your car, send her a bill. Forget lawyers unless you want to give a third of what you collect to him.

But if you are going to continue driving, do get insurance. You might not be so lucky next time.

well since the other person hit you they are at fault. but you are probably looking at a ticket or two for no insurance or license.. Definitly see a lawyer. Makes me glad I live in Kansas which is a no fault state when it comes to accidents...
