If you were in the driver's seat and in direct control of the vehicle (i.e. you could have been driving at any point if you wanted) then you were driving in the eyes of the law. Much like drunk driving. If you're drunk, sitting in the driver's seat with the keys in the ignition...its a DUI.

I don't know what State your in but, a little something that happened to me a few years ago, when I was suspended. I was just sitting in the car listening to the radio when a cop came up and ask me for my D.L. . I tried to explain I wasn't driving the car just listening to the radio. He wasn't trying to here it. I was actually arrested for operating without a license. It took awhile and some money but the way I beat the ticket was to ask for a bench trial and supeona'd the officers butt into Court. The officer didn't show up and the ticket was dismissed. If you have a witness
that can testify that you weren't driving, supeona them too. Unless the officer can say He actually saw you DRIVING, the case must be dismissed. Hope that helps. By the way this happened in Texas.

GOD BLESS/GOOD LUCK!!

Sitting behind the wheel of a car that is on is also a crime without a licence just so you know, he probably had a good reason to give you the ticket, pay the ticket sorry. You might be able to get out of the ticket in court if you can prove that you had a logical sensible reason for doing whatever you were doing. depends if the court fee is worth getting out of the ticket.

Take it to court and make the cop prove you were driving! Last time I looked, it wasn't illegal to be a passenger in a car.

If you truly were not driving with your license suspended, fight it. If you were, I would suggest paying the ticket and moving on. Either way, don't drive anymore until you get your license reinstated.

You'll have to explain that one a little more. You're leaving out part of the story.

What's the rest of the story?

Sounds pretty unlikely. Cops hate paperwork.

There is something wrong with your story. If you were ticketed, you were driving. There is obviously more to this story than you are letting on to.

What were you doing? Were you in the drivers seat?
