If it's a good environment for your child, then stay as long as you can. I had a child young and stayed at my parents until I graduated from college. I was a single mom and knew I needed to be selfless and do the right thing - get an education so I could get a good job to support my son. Always put your kids first.

You should. If you're not already, file for emancipation. =) I was 17 when I left home, but I was married. You can apply for emancipation at any time.
However, yes, you should be able to leave without her doing anything. You are that child's parent and you are therefore no longer a child under your parents dominion. Or at least that's how it ought to be.

well, when will you be 18? its cant be more than a year away. THe real world is really hard when you are young with a kid. I know I have been there. I would just stay till you are 18 and save all the money you can. Are you moving out with someone? need more details

You would have to look up the laws in your state. Also.. you can try calling the local police department. They could tell you if they would do anything about it. How long until you are 18? Good luck.. I know I wasn't much help.
Maybe these links can help more.

No, she can't (your mom can't take away your kid or throw you in jail with that alone)
However, look before you leap.
