My ex husband co signed for my daughter on an auto loan. His girlfriend was mad and he refianced the car with another bank and now he is the only one on the loan, title and regestration. I am quite sure that my daughter had to sign the title also and she did not. Either my ex did or his girlfriend did. He then showed up here yesterday and took that car. What is my recourse and where do I go from here? Per the original bank, she needed to sign the title also. Any help and advice would be greatly appreciated.

My daughter is the one that pays for the car. The car was titled, and regestered in both their names. The loan was in both their names. I called the bank with the original loan, they told me that they were both on the loan, and they both needed to sign the title to refiance it with the new bank. He refianced the loan in his name only, so either he forged my daughters name on the paper work and title or his girlfriend forged her signature. My daughter is the one that was making the payments. I have heard that if there was fraud and a name forged that there is something they call it and the bank can request full payment from him if they find out he forged her name. I am trying to find out that that is called.

My daughter is not a minor, she is 23. The loan, title and registration were all in both their names. Some one, either my ex or his girlfriend forged my daughters name on the loan,title and regestration. I have heard taht if the new bank find out that the loan was abtained by fraud, they can demand the entire balance of the loan from my ex, and I have heard that what they did is a federal offence. I don't want to fly off the handle, nor do I want to approach them untill I have all the facts I need. He is in the military,so if what he did was truly a federal offence, I don't want to do anything that will destroy the 20+ years he has in, I just want to get her car back and hold them accountable for what they did

Had she made any payments on the car? If so, the only thing that she is due is any amount of money payed for months that she could not use the car. So if she made a January payment but she could not drive the car, then she is due that amount. But being that her father is the cosigner, he is also the co-owner and has the right to take posession of the car and title it in his name.

who ever is on the loan has to sign off on loan and title unless she is a minor and it should have been notatized.good luck.
