508.060 Wanton endangerment in the first degree.
(1) A person is guilty of wanton endangerment in the first degree when, under
circumstances manifesting extreme indifference to the value of human life, he
wantonly engages in conduct which creates a substantial danger of death or serious
physical injury to another person.
(2) Wanton endangerment in the first degree is a Class D felony.
Effective: January 1, 1975
History: Created 1974 Ky. Acts ch. 406, sec. 70, effective January 1, 1975.

Individuals meeting the criteria specified by the bill include those who commit any of the criteria listed below in the commission of those acts;
1.Use force, violence, duress, menace, or threat of bodily harm against a minor;
2.Cause bodily injury to a minor;
3.Made friends with a minor for the purpose of committing an act constituting any of the offenses enumerated, unless the defendant honestly and reasonably believed the minor was eighteen (18) years old or older;
4.Used a dangerous instrument or deadly weapon against a minor;
5.Has a prior conviction of assaulting a minor with intent to commit an act constituting any of the offenses enumerated in this subsection;
6.Previously kidnapped a minor for the purpose of committing an act constituting any of the offenses enumerated in the bill;
7.Is convicted of committing any of the offenses enumerated in the bill on more than one (1) minor at the same time or in the same course of conduct;
8.Has substantial sexual conduct with a minor under the age of fourteen (14) years; or
9.Is a person who occupies a position of special trust and commits an act of substantial sexual conduct.

A person convicted of a Class D felony and meeting the terms of the bill shall be sentenced to a term of imprisonment of not less than one (1) year.
