In the UK older children are given a say in the matter. She should look at appealing against the decision, she would need some adult help and a lawyer;

In some states there are laws where at certain ages the child can make there own choice. Did your sister get to talk to the judge, did she have her own lawyer? those are a couple things you could check into. Maybe call child services explain the situation and see if they will help her get her own lawyer. But make sure that if she is wanting to live with your mother that there is nothing saying she is unfit to keep her or it might be a waste of time unless you would like to take guardianship of her yourself. Then you could get some support from your mother and father both to help you. Good luck!

It would help to know which state you live in, but anyway, most states allow a person, after they reach a certain age to live with whichever parent they want to live with. you said they had a hearing with the clerk? this would have to go before a judge or family court judge, not a clerk. does your mom have a court order signed by a judge ? cause if not then i don't think its legal.
better have her contact an attorney. both to see if its legal and then to help your sister be heard.

I don't understand why no one asked your sister who she wanted to live with. At her age, I think she should have some say in the matter.
However, is there something going on at your mom's house that your dad can use to get custody? Is your sister doing things that your mom should not be allowing?
There must be more going on than you know --or than you are saying.

UNFORTUNATELY this situation happens .. and your sister did NOT get to express her true desires.
YOU can only tell your sister that you care for her, give her your Address/Phone Number, and if she needs to find a safe place to live (there must be another reason besides she 'doesn't like the step-parent ... ) to CALL the local Shelter, go there, and then request that they CALL YOU too so that you can insure that she is safe, and provide for her a SAFE HOME.

He can truly try. doesn't advise he will be triumphant, till your sister needs to flow with him. Plus in case your mom isn't in a sturdy homestead with a sturdy paycheck, odds are on your dad's pick. good success, and with somewhat of success you realized out of your blunders.

no you can not let her chose the preantal guidience. but you would just have to have your mother fight a good fight and wade it through. if she lives with her dad and step mother it will only bve 2 years that no biggie

I think in some states you have to be only 12 to decide. She should be plenty old enough to decide for herself.
