Thats why the police don't get involved, I think it's called a habitual offender.
Too much hassle for them.
I would be tempted to "find" new damage to the car, to force them to act!
if the guy is well known, ie a nutter, keep out of his way.

You correct. I have worked in and studied the Private Security Field for years. You should know, however, that all experts recommend you do not attempt a citizen's arest for many reasons: 1) If it is not a felony, but a misdemeanor, you will probably be sued. 2) If you don't have the proper training on law you will probably be sued. 3) If it is a Law Enforcer you will probably be beaten, assaulted, or killed. 4) It is highly dangrous to life and limb without proper training. Yes, you CAN make a citizen's arrest for ANY crime, but you should not ever do so unless it is a felony because you require two or more witnesses otherwise along with a damn good amount of proof. YES, you are not required to read Miranda Rights. YES, you can always use force to detain, but you need to be absolutely certain and able to proof you are correct, or you will spend your entire life paying for a lawsuit. It is not really illegal to resist a citizen's arrest, but the criminal may be charged and/or sued with assault if they do! I wouldn't detain them for more than an hour if the police did not arrive. However, in that time I would attempt to gain information from them to give to the police. If you are under a citizen's arrest they CAN transport you without consent provided they have already made the commitment and are willing to suffer the possible consequences - citzens are not immune from screw-ups like law enforcers. If you are under a citizen's arrest the best thing you can do is IGNORE the citizen, give them no information, and leave the seen immediately.

If the police see this person doing it, they would immediately stop them and at the least caution them for public disturbance and even arrest them if the situation warranted it.
If you were verbally assaulted (your message is not too clear as you say both that you kicked the car and that your car was kicked by someone else) then it is up to you to pursue some action from the police, especially if there is a witness.
Once you have calmed down and ensuring you are able to keep your cool (perhaps go with a friend or someone you can trust who has a moderated temper?) try going to talk with the police and find out exactly what the situation is and what can or can't be done. Treat police as friends and they will treat you the same - remember, they are only PEOPLE doing their job at a huge personal risk to themselves!

I am very surprised at the lack of interest. Get the details of the witness go down to your local police station and report the matter in person, if still no interest then enter a complaint. The Police should take this matter forward especially as the person, as you say is known to the Police.

You've already asked this question and in it you said that you initially thought that you'd hit the man, then said that he kicked the car.
What do you want the police to do? Do you have any witnesses, because your story began as one thing and then changed to another. Why would the police take that kind of allegation seriously?!
I'm not doubting your story, but try and see it from the point of view of the police.

Yes they can arrest you. Doesn't matter if there is damage or not. I would definitely arrest you if I saw you kicking a car. The police are not going to care if you tell them it happened to you yesterday so that's why you did it to someone else. Try this and see if you get arrested. I'll bet money you DO get arrested.

For the most part I'd say you got off lucky. If the police know this guy, that's not a good sign. Just a friendly reminder, The biggest losses, are usually not worth it. Next time someone could wind up DEAD and for what MACHEISMO, death is not something a doctor can stitch up. There's alot of crazy, inconsiderate people
in this world and dying with or at their hands is not smart. A Bigger Man excepts the STUPID people and lives. But to die with, or over one,........ that makes you just as stupid!!!!

I know how you feel. Last week a scaffolding crew decided to park in my driveway and refused to move. When I said "move it or I'll move it for you" the driver threatened me with a steel rod.
There was nothing I could do as a law abiding citizen but walk away. Just not worth it.
It's the price we pay to live in a relatively free and open society. The police can't do anything and the buggers know it..

Yes you can, it is considered agressive behaviour,it is down to the recipient of this behaviour if they decide to press charges. take the anger out on inert things, like wardrobes.
I attacked a wardrobe with a sword once and destroyed it. It was very therapeutic.
