to 3 years w/ 1 being suspended in a correctional facility for criminal wrecklessness. This is his 2nd felony. The first was a DUI. This time, when his now ex-wife told him that she was going to divorce him (she was having an affair with his best friend) he got angry, upset a few things but started to calm down. Meanwhile, she took herself and the kids to another room. My nephew evidentally fired a 22 rifle in the opposite direction while trying to clean it. She called the cops and he got arrested. At the trial, the prosecutor brought up his juvenile record and his attorney didn't fight for him very hard. Who is ok with his sentencing?

Juvenile records are supposed to be sealed! I'm not okay with the sentence, that's WAY too much for the situation you described... but he was reckless, a gun should never EVER be loaded while you clean it!

Well I do not know your nephew so I do not know what kind of person he is. You say that the gun discharged while he was trying to clean it. I am sorry, but I am not sure I buy this. First of all, who attempts to clean a loaded gun. Secondly, if he was already in an agitated state, he should not have brought himself anywhere NEAR a firearm, even if he was trying to clean it. Lastly, it is my understanding that convicted felons are not suppose to be in possession of a firearm. Based on the events that took place, I can see why the police arrested him (and believe me, I generally do not side with the cops!). I also have to question how he received a felony conviction on a DUI? Was it his first DUI? I wasn't aware of any state that considers a first (or even a second) DUI as a felony. Did he have multiple DUIs? Or did he do something during the course of the DUI that lead to a felony?

He got angry then a few minutes later he decided to clean his gun, sounds a little far-fetched to me, which is probably what the prosecutor saw too, especially since the children were in the house when it happened, it just does not look good. Then his record on top of that, sorry to say but, yes it does seem fair.

I'm ok with it. What was he thinking driving after he had been drinking! He could have killed someone!!!! Seriously.

And to make matters worse - I know first hand that felons are NOT allowed to posses firearms (BUSTED!) So what was he doing with a rifle? Hmmmm?

Maybe next time he will not feel the need to "clean" his gun right after a fight with his wife.

Don't forget to remind that sweet little 'ol nephew of yours that 3 strikes and he's OUT!

I think he has been punished enough, what with the loss of priviledges and the grounding, it is completely unfair to expect a child (yes, he is 16, but he is still a child, or by law he would not be considered a minor) to miss out on a major holiday. If they tell you to return the presents because he doesn't deserve them, tell them they can do whatever they want in regards to their gift giving or lack thereof, but you feel he should recieve the presents, especially since you have already purchased them, and come on, this is Christmas. What happened to love and forgiveness?

I think it is fair. He should never had been touching a gun if he was angry and fighting. Cleaning or not thing happen and that was really stupid.

juvenile record can not be held against him, unless he is still under 18.

seems to me he is a bit of a ealous hot head and needs to be locked up until he can learn to control himself
