I have a great opportunity to move to Texas. My parents recently moved there and are willing to buy me my own house there and pay for me to finish college. I currently live in Ca in a rented apt and on my own I won't be buying a house anytime in this life time.

I have a 2 yr old daughter and her Dad is not really involved in her life. We live about 100 miles apart and they talk a couple of times a month on the phone with really limited visitation . He has paid very little child support in the almost 3 yrs she's been alive and just overall is a user and an idiot. The whole reason we broke up was cause he couldn't keep his hands to himself. An I kicked him out the house with the clothes on his back. The cars and the Apt were in my name.

I mentioned the idea of moving and he said I can move anwhere I want but my daughter stays with him. He can't take care of himself- he lives with his Grandma. Can he force me to leave her if I move to take advantage of these great opportunities?

If you have full custody of her, you can do as you wish...but if her father has any custody at all, and you take her out of the state that is kidnapping. you might want to contact your lawyer to be sure. He can't force you to leave her with him, but you two may need to work something out so you can go. try to get full custody of her and you will be fine.

If there's a court docket order for help and visitation, that order also controls your modern question. examine the order. in case you do not have it, it really is on report contained in the clerk's place of work contained in the court docket that issued the order. They often forbid leaving the state with the toddler without first getting an ok from the court docket. That permission isn't automated because the court docket could evaluate no matter if the recent visitation association is contained in the suitable pastimes of the toddler. be conscious that couldn't an identical as your pastimes. instead, the toddler's pastime comprise having both father and mom as portion of her life and the court docket will be hesitant to let the flow till you've a finished plan for making particular the daddy continues to be in contact contained in the toddler's life. in spite of the undeniable fact that, none of it really is for particular till you examine the court docket's orders.

It depends on whether you have a child custody order from the courts. If you do there may be something in ther about leaving the state your ex resides in. If you don't have a court order then you can do as you please. The only way he can stop you is to go to court and fight for custody or set visitation.

NO!!! You are the custodial parent and sole care giver. MOVE and get on with your life. He can still make the same two phone calls a month!!! Don't cater to someone who doesn't care like him. GO!!!!!!!!!!!!
