I think so, what a great idea. The high court found that Nohe Gomes Hernandez ``misappropriated the Social Security number of Jason Smith,'' and that he ``then used this misappropriated number to obtain a Social Security card and a California driver's license in Smith's name'' so he could get a job at a northeast Georgia poultry plant.
Hernandez was sentenced in April to two years in prison after a jury found him guilty of violating the ID theft law. Authorities learned about the case when the real Jason Smith, from Danielsville, Ga., applied for a $600 tax refund, but the Internal Revenue Service said he owed $12,000 in back taxes.
But illegal supporters will tell us how they only want to work and don't hurt us. In a pig's eye.

Hey Owen, there is no such thing as a native American as you bandy the terms about. And I am 3rd generation born and raised here, you have no argument if that is all you have.

This actually happened to a friend of mine. The illegal was not only using his social, but his name too. The real kicker was that they worked at the same plant! ...they just omitted the middle initial and used (obviously) a different employee number so that two seperate checks were issued. Someone in administration of that plant was taking pay-offs from illegals in exchange for names & socials. (Can't say he was too smart about it though!) It did take some doing, but my friend did get things cleared up. The administrative guy only got a slap on the writst & was fired. Here's another problem for some people in this situation. A lot of these illegals know the system really well. They claim a high number of deductions, mimimizing the amount of taxes taken out of the check, and then it creates a potential tax burden for the person who really owns the SSN. While it takes some legwork, the true owner can get the matter resolved. ...I've seen this happen too.

I hope if the illegal actually "gained" wealth / property ect. from the use of a stolen ID, that common law and Admiralty law dictates the seizure of said property and surrendered to the real person. THAT would be a great test case and if successful the end of ID theft by illegals.

Georgia and every other state should jail and deport every illegal alien whether or not they have stolen an ID or anything else. Just being here is illegal and they need to be removed. All of them. The hard working honest ones. (How can you be honest and living in a country illegally?)

Of course they are right. I only wish the sentence for identity theft was longer. It will probably take Jason Smith longer than that to get his credit and everything straightened out.

you can jail them then deport them, but it doesn't matter. I have a family member that works at the local jail and they just deported the same guy for the 3rd time with a third name and ssn..........as he walked out with immigration this time he turned to the local sherriff and said "see ya in 6 months!!!"
They will just come back and get someone else's ssn and make their life hell.

They stole identifications from citizens of this country. I wouldn't care if they were citizens. Stealing is against the law. Of course they should be punished for it.
