this was in the uk,i was sitting in my car drunk outside the pub one night when 2 policeman took me to the station where i was asked to take a breath test i did not refuse this test i just made sure i didnt take it properly. i was not driving the car but had the keys on me, i am in court next week and would like to know what treatment is the norm in this case

you are expecting a ban and a hefty fine so why not just go out there an try something really wacky as it wont make any difference unless maybe you will get off with it......tell the court that you was in the pub drinking and had no intention of driving home as you had drank to much and the next thing you you felt faint and blacked out and you now realise you had been spiked with rohipnoll the date rape drug as you have been spiked with it before and been told that you had it by the person who spiked you so you recognised the effects and kept passing in and out of conciusness and could remember some people who you could not recognise were carrying you. then you didnt know where you were untill the police men were stood at the side of your car. but still felt like you was not in controll of what you was doing even at the station so you could not properly take the breath test. hey presto you are not to blame for anything that happend if that really happend then they would be wrong to ban you. it may sound very cheeky and imoral but who cares in this life you just try to get away with whatever you can and they are no better than you for it. oh yea and they are all scum anyway the police and the magistrates as they harassed me for 6 years cos two drunk coppers crashed into my girlfriends car and got me £20,000 in fines lol but i did a out there thing and spent my fine money on a damm good solicitor and now i have no almost no fines and a clean licence backdated 6 years as having no points or bans so the out there thing can work if you plan it correctly.and as for davy b ,,if it was for real then what evidence can be got??? and as far as the law is now its not a matter of what really happend its about what evidence shows,but if there is no way of getting evidence then how can they gather evidence to proove you lied and if there is no evidence its a matter of takeng peoples word for it so go for the story i told you i think it will really work. the law works in a very imorral strange way these days.

You were drunk in charge of a car,you will lose your licence for around 2 yrs,a fine of £250 and future insurance premiums will treble.

ya will still get done 4 drink driving, as ya was in the car and you could potentially drive the car, ya could get a 6 to 12 month ban, ya might have 2 retake ya test, good look xx

i work at a magistrates court and in my vast experience i have to say it all depends on your story and the magistrates you appear in front of on the day.

minimum is that you will get points and a fine but usually you will get a full ban, minimum is a year.

if this will effect your work then you must tell your solicitor as that can be taken into consideration.

you would have been charged with drunk and in charge of a motor vechile and failing to give a specimin of breath.....
you are looking at a 12 ban and a fine of around 450.00.
if this is your drink drive charge....

they have to take it that you were preparing to drive your car,you could of been going to if they didn't turn up,sort of thing. Drunk in charge of a vehicle perhaps points and fine.

If you were over the limit in your car, its a drink driving conviction for you, serves you right - no sympathy here im afraid.

you should definitely expect 12 months ban and a fine, possibly points on your licence as well. you will struggle to get insurance when you get your licence back too- sorry
