I live in Utah - I was told by the HOA that the other units that have done this did not get proper approval - and were completed under a previous HOA board. My point is that if they're not enforcing the rules against the other homes, how can they enforce them against me? I did speak to an Attorney who told me this was selective enforcement, and for a large sum of money he would submit a ceritified letter stating so. I'm not sure if he really believes in my cause - I think he just wants my $$.

Any suggestions?

My solution to hoa's is not to ask. I have found that even if they approve something (as they did in a family members case) they reserve the right to change their mind, even if they previously gave you approval for it! I'd probally just do it, then if they were going to sue me I'd say OK, sue the other 4 home owners. What judge wouldn't rule in your favor? Good Luck.

P.s. I HATE HOA"S!!!

Most lawyer's cost so much, I don't think their worth it. My family has fought things without them and won. You could see how far you get then hire one if I went to court.

He definately smells dollar signs. Are these separate homes or condo's? If condo's just buy dinner for the board chairman. If separate homes on land that you own, then don't even bother to tell them to bugger off. Just do what you want as it's yours not theirs and this is telefunkin' America NOT China.

Its too bad you already asked the HOA if you could do it. I would have just built onto it without asking.
HOA's suck! I bet they take your money every month, though don't they?
