me and my old employer hate each other. and i know that she will keep my w-2 form not send it off to me . i have seen her do it to other people. i know that she has to jan 31,2007 but i wanted to know if i could get the form from the IRS alfter that date.

Your ex-employer can not hold that information. The IRS does not have that information unless your employer sends it to them. They must send it to them for their tax purposes. If they don't then they can't receive the tax benefit for having you as an employee. If there is a seperate accounting department or a CPA firm that does their taxes then you could probably request that information from them instead of your ex-employer directly. Also, you could just look on your last pay stub and you will have the numbers that you need to do your taxes. If you have worked for the employer more than one year then you can use your previous w-2 for the employer id number. Or if you use turbotax on the internet then they keep that information as well. Excellent advice from Glibby3 but if it takes too long, call (800)–829–1040 and ask for a listing of income and withholding that has been submitted in your SSN. I believe they will provide it free of charge.

You can also file a substitute W-2 using the form at the link below (use your last paycheck stub to complete the form).
The instructions at the bottom of the form say not to file it until April 15th, but I believe the IRS accepts the form starting mid Feb.

If the employer does not give you the W-2 by the required date call the IRS and let them know. They will contact the employer and I have yet to see an employer continue to withhold it from the employee after this contact.

Request it in writing from your employer. If your employer does not give it to you, they are in violation of tax laws, and you should file a complaint.
