You can claim them as dependents if you provided more than half of their support.....now dear, the problem is figuring out if you provided more than half the support. There is a support test but the worksheet is confusing if you are unfamiliar with it. If you like I can look over it for you if you email me.....you can also take all the pertinent info to your local Jackson Hewitt Tax Service office....to find the closest office go to

www.jacksonhewitt.com hit office locator, enter your zip code and you get a list of addresses and phone numbers. You can also call 1-800-234-1040, enter your zip code and you will be transfered automatically to an office in your area.

You would have to prove that you provided over half their support. Is your pay at least two times the total of the disability payments? If not, there is no hope you could prove that you paid more for their support than they paid themselves.

Did you also live in their house? They provided their own housing and the fair rental value is part of their self-support in addition to their disability checks.

So it is not likely you could claim them as dependents.

You can claim almost anyone as a dependent on your taxes regardless if they get a check or not. If audited you will have to prove it (which is where the dependent test is valuable).

However, if you parents are cooperative you can get a statement notarized saying that you provided more than 50% of their expenses ( I think the percentage is lower than 50) and was their primary care provider than it is perfectly legal.

If you find yourself in that situation again, or if your parents need your assistance on a regular basis. You can get a limited power of attorney and it can make tax season a lot easier for you.

Good luck

it's a bit more complicated than that,to my knowledge you cant actually claim them.but there maybe other associated claims that you can.ie:the cost of transport?
different tax laws in different countries but a lot of western countries are simular.if you can't work out the tax laws for yourself you should see an accountant, especially regarding complicated issues.

no you can not because they both receive a check and are not completely dependant on you.
