According to the UN resolution 242, taken after the Arab Israeli war in 1967, and the partition of Palestine between a Jewish and an Arab state (resolution 194 of the United Nations), the west part of Jerusalem should belong to the Jewish state (Israel) and the east part belongs to what was supposed to be an Arab state in Palestine. So officially, in the international community and law point of view it is not completely in Israel, but practically it is because the Israeli state annexed it.

Please ignore the previous post mentioning 'Palestine'. This is a modern concept invented in the 60s by anti-semites to deny the state. It is derived from the Roman word 'Palestrina' which means the land of the Philestines. The Romans renamed the 'province of Judea' to 'Palestrina' after the Judean wars as they were upset that the Jews never accepted colonial Roman rule. The Philistines were greek invaders to Israel 1000 years before. The christians took up this name after Rome converted the empire to christianity (Constantine). What is most amusing is that muslims use the word 'Palestine' to name Israel, as its a christian concept which denys muslim control. Life is full of ironies :)
