I went to a club last night and I was frisked by the club's security by a person of the opposite sex. As she was frisking me, I asked her if I shouldn't be frisked by a man, and she said that the guy that usually does it was not around right now. As she was saying this, she touched my penis, I believe as a result of my question.

Were any of my rights violated or did my entry into the club constitue waiver of my rights?

When entering a place such as a club where security is a necessity, upon your payment and entry you are subject to a frisk. Doesn't matter if it is a man or woman. If you didn't want to be subject to that, then you get your money back and not enter the club.

You go to a specific club, then you are bound by that clubs rules. It is your right to refuse to be frisked by anyone that you choose (when not being arrested, of coarse). However, just like it is their right to set rules, if you refuse to get frisked by whoever is standing at the door, you don't get to come in.

There is no law (that I am aware of) that says civilian businesses, when frisking customers, has to have persons of the same sex doing the frisking. That is something that would be up to the owner of the business and the patron coming into the establishement.

Most of the time however, to avoid a potential lawsuit, the clubs will have males frisk only males. Very few of them will actually have a female on duty to frisk the females. If they do have a female at the door, she can still pat you down just the same. That is if you let her do the frisking...

Private security can do what they want. within reason officers have different policies according to their department. My department allowed i for a male office to search a female with the back of his hands. I found this not a very good practice so I did a full search on an arrested subject. , male or female I have found lots of stuff from razors, drugs guns etc. I never had a problem with my department. the key is not to linger unless you find something. The search is for the protection of the office, and I would never put an arrested subject in my cruiser without a full search.

It's possible....but you could file a complaint with the club owners and/or security company who supplied the officer.
You may want to consult an atty. who specializes in harrasment cases.
You may even go as far as filing a criminal report.
All in all it's an he said she said thing.

yeah, i have seen/done it. i am obvously being careful to respect the pvt areas and it is only a "pat down". the real search comes later at the processing in the jail
