Yes, the car must pass smog check before selling the vehicle unless the car is less than 4 years old.

Dealers must SMOG their cars when they sell, this is the reason they charge $45 smog fee.... but not private parties. The buyer is responsible for smogging the vehicle when the time comes (renewing the registration). If it fails, you are responsible for repairs. This is one of the risks of buying from a private party. This is also why you should avoid cars with expired registration because one of the reasons might be because it failed the smog check.

Technically, yes. "Professional" dealers always do this. Private parties usually are working on a negotiation basis: meaning, buyer beware, but if the seller agrees and the buyer agrees, then the buyer can take responsibility for the smog certificate.

you are able to sell it "as is" legally. I even have completed it a dozen situations. I even have additionally offered vehicles that mandatory restore, fixed them and smogged them myself. merely ensure you change in the type pointing out who you bought it to so which you wont be to blame for any destiny tickets and so on. (experience taught me THIS lesson) CA resident.
