If the judgement can legally be settled by taking your refund, then yes. Most judgements cannot automatically take the tax refund in settlement, at least not without your consent. Child support and student loans are the most notable exceptions.

she can file a claim called (i think) injured spouse or something like that,or you can file separately, it took my brothers wife months to get her half of the taxes back

you still have to give your half if you owe though,they never stop coming after you either

She has to file injured spouse. They can't take her part of the return. Only yours from your income.
