CC company every month. Should i send my payments to my CC company or deal with the people calling me??

You need to contact them both and explain to them that you are being improperly dunned thru a collection agency although you are making normal payments directly to the credit card company. You need to tell the collection agency directly that what they are calling for is NOT in collections and that they are NOT to call you again. You have to say it specifically like that. That they are NOT to call you again. If you don't say that, they can keep calling you forever.

Once you say that, if they DO call you again, call the phone company and tell them that you are being harrassed by the collection agency - they keep calling you for something that is not in collections and you verbally told them to not call you anymore - then give them the phone number - the phone company will block the phone calls and send the harrasment complaint to the proper authorities for prosecution.

If you are still getting statements from the CC company, they still own the debt. Any payments made to them will be applied to your account. I don't know if the collection agency has any legal rights, but any they do have are subordinate to those of the CC company.
