Do previous employers have to give their records to the police even if it is against their company policy?

A criminal record is public record but an employers records are not. It depends how bad the investigator wants the information if he is willing to pursue it. The employer may raise red flags to the investigator which might cause him to look further like I stated above.

They usually do not need prior employer records. A police department will and should do a very extensive background on the person they are looking to hire. If you are hiding something from a past job you want to be open and honest about it from the beginning. If you are not they WILL find out and then you will not get the job because they have now proven you to be a liar.

No, they don't have to cooperate with the police's request for info unless it is subpoenaed, but this could put a crimp in your background investigation.

They might not ask for records. They would just want to speak to your supervisors about what kind of person you are, and how you performed at your job.
