NO. Federal law does not allow the consumption of marijuana in any form. The Federal Government ties funding to States thru compliance of the law. This is part of the reason why so many States who have medical marijuana laws are in legal battles with the federal government. There are some States where the punishment has been dropped to a misdemeanor where a fine, little or jail time is paid by first time offenders.
An interesting fact: To make a manufactured drug, such as cocainee, illegal you can not just say in the law "cocain is illegal." What is outlawed is the chemical compound that comprises it. So technically if somebody "invents" a new cocaine its not illegal until the law is amended that encompasses that new compound.

It is not legal in PA, and paraphernalia is still illegal. They may have taken some stuff off what they consider drug paraphernalia. It would be super dumb to get busted for drug p. if a doctor prescribes it then you can legally buy it at licensed pot dispensary in California. With doctors prescription it might be legally obtained Arizona not sure about that. it will be legal nation wide someday and people will realize how duped they were by some lobbyists.

The real reason is that unlike tobacco, pot can be grown almost anywhere so it's hard to control. Because where it is grown cannot be controlled, they can't tax it like they can with tobacco. No taxation means they don't get their fair share or control of distribution.
Pot has many uses, some of which threatened the logging and petroleum industry so of course, lobbyists got their way and it became illegal. It's all about politics.

In your house. They can't really bust you for smoking unless you're already in trouble such as probation or parole.
If you have more than a half oz. (I think) they can bust you for intent to sell. There are places I know of in Louisiana and Mich. where you will get a bigger fine for skating on the sidewalk.

We currently have federal laws which prohibit the sale, transport, and possession of marijuana. And, of course, it is illegal to use in public.
You can smoke it in your house legally, however, being in possession of it is against the law, so that law sort of overrides the "legal in your house" part. Medical marijuana, however, is legal to have, given you are authorized to have it.
