No. If he files married, but seperate, the money he paid for school does not count towards deductions.

It is true that married filing separately means you get to keep your refund. However, married filing jointly almost always results in paying less - sometimes much less - in tax. Yes, it will be a pain not getting a refund (or a much reduced one) if you file jointly.

However, the student loan debt is not going to go away until it is paid off. You may as well get the maximum refund you can and pay it off much sooner as a result.

I think what your saying is they may keep his refund because he owes student loans. I am a volunteer tax preparer and I believe it would be better for you to file married joint so you can get all deductions. Then ask your preparer to file an injured spouse form so that you will get your share of the refund. You should get a larger refund that way. Good Luck!
