No, his military service which requires him to be away from home is not considered absence from your home for purposes of the Head of Household requirements.

No, if you're married you have to file joint or else married filing separately.

There is an exception where someone who is legally married can file as head of household if they have a dependent child living with them and their spouse didn't live with them at any time during the last half of the year. But this does not include temporary absenses like deployment.

Good luck - I hope your spouse comes home safely.

No you can't and you wouldn't want to. Married, filing jointly is going to be better anyway.

If EIC is an issue, remember you have the option to count combat pay or ignore it for EIC purposes. Obviously, you will choose whichever one gives you the larger credit. If you choose to include it for EIC purposes that does NOT mean it will be taxed. It's a win-win situation.

See an experienced tax professional to help you through this.

Like Judy, I hope your spouse comes home safely.

No...you have to file whatever your legal status is. If you are married, you file married.

Head of Household is for single filers with dependents.

Your choices are married filing jointly, or married filing separately.

You may want to contact your Accountant to inquire about this first. There may be implications that you may need to know before you file.
