Hi, i got a very close friend who's been going out with this guy who's 22...her age is 17 and she lives in NY. Is it legally safe for these two to be together?? I'm concernd for thier safety, 'cause she has a family realitive likely to call Child Protection Services on her and him and I don't want either of them to get bashed by the law on such a dumb note of age difference, since they are both my very good friends. Please no smart or making fun of.....or joking answeres. This is a sirrious matter to me.

I was surprised to read the answer above that the New York age of consent is 17 years, but he's right. I checked it here:

http://www.avert.org/aofconsent.htm

So your friend is not breaking any law and neither is her boyfriend, even though 5 years is a huge difference in their ages and she should be encouraged to not be having sex with this guy for the same reasons that "Age of Consent" laws exist in the first place. He's too old, she's too young, the age difference is too big and the risk of pregnancy and serious emotional damage to her is still there.

Here is the law. Age of Sexual Consent is not exactly specified in New York law. By reading this you will understand. When in doubt seek the comptent advice of an attorney. Better to pay good money for good advice and be forewarned, then to pay good money for a legal defense.

Not dumb, very few 17 year olds support the babies they make . They become welfare burdens.
When she is legal & employed & can support herself and not living off of the relatives , then give us this story.
Otherwise , child protective services should be notified .
And your story is proof , proof , proof about the dangers of old guys and high school girls . Actually he is the one that will do the jail time though. If she cared about him, she would limit their visits to supervised day visits . . . unless she has already got boyfriends in jail . and that is her thrill .

You would have to check your states laws about the age of consent. It is most likely 16 but even if it was eighteen it would not likley lead to a convictions for statutory rape

most of the time time if they are having sex and it's consentual by both their isnt much anyone can do to them, however most states look down on males who date under age girls, but i'm mean how soon will she be 18 is the real question, after that she's considered an adult.

In New York it is 17. It is legally safe. Don't ask me if it is a good idea, because I don't think so, but that is your legal answer.
