I parked my car on chevrons next to a drive and it got damaged by the person who owned the drive. I saw it happen and have asked for their insurance details.

Does anyone know if I can claim?

Let's see...accident...not your fault...insurance...divide by 2...add 7...carry the 1...

OH COURSE YOU CAN! But make sure to claim with the persons insurance first. If their insurance doesn't do the right thing, file the claim through you own and allow them to sue to recover your damages.

Now, the only hiccup might be this: You don't mention if the owner of the drive was also the owner of the vehicle that damaged your car. If he/she isn't, you might be on a slippery slope.

And you didn't mention that you were illegally parked!!! Shame on you!!!

Let's see now...illegally parked...divide by 7, multiply by the uh-oh...

YOU HAVE GOT TO BE KIDDING!!!! You were illegally parked. If you had not been illegally parked, you would not have been in a position to have your car damaged. If I was Judge Judy, I'd make you look like a fool before I finally threw you under the bus.

Shame on you for trying to collect on someone else's insurance when you're the one breaking the law.

If you've comprehensive insurance then it will get repaired anyway. The two insurance companies aportion blame as to who was at fault with the information they are given.

However, the fact you were parked on chevrons thus illegally and dangerously and the person coming out the drive wouldn't expect a car to be parked there, then the chances are your going to shoulder the majority of the blame.

If your asking if you can pursue for uninsured losses due to your illegal parking if you dont have comprehensive insurance then the answer is no. No solicitor worth his salt would try to pursue it on your behalf.

Even if you were illegally parked you can still claim thru the other persons insurance. Your car wasn't moving, parked and they hit it. Where I live the other person is at fault 100%

of course you can, they hit your car. what else is insurance good for except taking your money?
