I am divorced and have full custody of our 4 children. We agreed he claims the kids as depend. on taxs, can I claim them on EIC then? Also, we have a 19 year old that stayed with me 6 months before going to college can I claim him for EIC?

You can claim your children for the EIC as long as your ex husband doesnt take any credits on his taxes for the children. Only one parent can claim the children as their qualifying child and receive the credit. Usually when a parent claims a child it is because they want the EIC or other credits for that child so I doubt if your ex husband will claim the children and not take the credit that comes with it.
Also depending on your income you may not even qualify for the EIC. If you are filing head of household your income must be under 35,263 to receive EIC. If it is under this amount, the most you will receive in EIC is 4400 dollars. That is the max amount whether you file 2,3, or 4 children.
My suggestion is you file 2 and let your ex husband file 2 and that way you both can get the max EIC and you wont have to worry about the consequences of you both filing the same child.
As for the 19 year old, as long as you provided more than 50% of his support you can claim him but it would not increase your EIC.

Being divorced you can release the dependency to your ex; on your return you file as head of household and take the EIC. The 19 year old student is considered to have been living at home the entire year but you only need 2 for the maximum EIC. You might negotiate with your ex and see about 2 children each so you can also get the CTC of a thousand per child; which is what your husband is going to reap with the dependency.
