When does your employer have to have your tax return statements to you? And if they don' t get it to you by that certain date what can you do?!?!

Your W-2 forms? They can postmark 'em 1/31/07. I've had employers sit on them until the middle of March. There really isn't any excuse for that and about the third year they did it I called the IRS. The IRS sends them a letter and you will be identified as the one looking for your records, so if you still work there you will have to weigh the consequences of having the IRS contact your employer. Employers don't really like that sort of thing so it may come back to bite you in the butt.

Your employer has to have the W-2 to you by January, 31st. They have until February 28th to file them with the government. This filing date can be legally extended for two months. If the employer fails to file by the February due date they are subject to a penalty for late filing of $50 per W-2.

You can go to IRS.GOV for specifics. I have done tax work for 36 years and can also answer many questions. I believe you are in refernce to the W-2 form that employers give employees showing wages earned and taxes withheld and turned in. By law the W-2 is supposed to be in your hands by the 1st of Feburary. You have to make sure the employer has your correct mailing address.

I'm fairly certain that your employer has to have them to you by January 31.

I don't know what the penalty for not complying is...

They must be sent to you no later than January 31st. If they mail them, you may get them later than that. If it is a prior job and you have moved without filing a change of address, it's on you to contact the employer.

I'm not sure what your recourse is if your employer fails to attempt to get them to you.

They are suppose to be penalized but most of that do that have them post market for January 31 but don't have it out by the 31st.

I believe it is by Jan 31, if they don't get it to you, call them and ask for it.
